Two examples of how I could use Fair use in a film that I was producing would be using a clip for commenting or critiquing. The Tosh.O show is a great example of this. The entire show is based on playing YouTube clips and making fun of the people in them. Or for creating a video in order to launch a discussion in an academic setting.
Fair use is extremely important to documentary makers, especially in the history genre. If you watch the history channel, their documentaries are loaded with old video clips. However, with it being the History channel and their enormous budgets, they probably have purchased the rights to use these videos, but it makes my point.
